Law against cellphones while driving only designed to create more revenue

Could someone please explain to this old brain the difference between talking on a cellphone and talking to your passengers? There appears to be no difference.

I hear holding a cellphone takes your hand off the wheel. Well, so does holding a cup of coffee, or anything else, and that’s legal. It’s also legal to use a hands-free device, which only means you can talk while holding a cup of coffee.

Far as I am concerned the whole law is designed to generate more revenue for a city or county, and that should be illegal.
