A Franklin County Superior Court judge on Monday pushed back the trial of a Sunnyside man charged with killing a teenager outside a Pasco dance club in August.

Enrique Alcaide, 22, is now scheduled to go to trial on Jan. 4 for the death of Eduardo Angon Del Villar, who died of gunshot wounds at Lourdes Medical Center following a fight in the parking lot of La Tropicana.

Alcaide was originally scheduled to stand for trial in November but delays in the case, including the need for a hearing on a motion from prosecutors to combine his case with that of his uncle, Santos Flores-Alcaide, 28.

Alcaide is charged with first-degree murder in Del Villar’s death while Flores-Alcaide is facing first-degree murder and assault charges, as well as possession of a stolen gun.

Del Villar, 19, of Pasco, reportedly was outside the West Columbia Street club at 1:30 a.m. on Aug. 30 when he was confronted by Alcaide and his uncle, court documents said.

A fistfight broke out between Del Villar and Alcaide, and Flores-Alcaide ended up firing several shots at close range at Del Villar, then turned the gun on another man who tried to help.

Prosecutors filed a motion in early November to combine the cases against the nephew and uncle. “It is the contention of the state that due to the large number of witnesses and the fact that the defendants acted together to commit the alleged offenses, these matters must be joined for trial,” argued Franklin County Prosecutor Shawn Sant.

Alcaide’s attorney Richard Smith said there needs to be separate trials because his client’s case has been handled separately from that of his uncle since the beginning. He also said the two could become antagonistic since Alcaide has accused his uncle of firing the gun.

The matter is currently set for a hearing on Dec. 8.

Smith also told Judge Vic VanderSchoor that he’s yet to receive all the evidence he’s requested from prosecutors and is still waiting to hear about how they want to pursue interviewing witnesses.

Prosecutors told the judge they hadn’t seen all of Smith’s requests and VanderSchoor told both sides to meet and work out the details.
