A Pasco man is accused of having sex with a woman who was heavily sedated after an emergency room visit.
Kevin Howard Kelly, 24, pleaded innocent to indecent liberties and is scheduled for trial Sept. 26.
The felony charge involves knowingly causing a person who is incapable of consent while mentally incapacitated to have sexual contact.
Court documents state that Kelly cared for the woman after she went to a Tri-City hospital for a medical problem. She was given strong prescription narcotics and reportedly was not alert for a few days.
The woman called Pasco police several days later, saying Kelly told her he'd had sex with her after her release, but she "does not recall the incident" because she was medicated and did not give him consent, documents said.
Kelly later told police the sex was consensual, documents said.
