A Tri-City judge found in favor of Benton County and dismissed a breach of contract lawsuit by the Columbia Irrigation District.
Superior Court Judge Alex Ekstrom made the decision after a three-day, non-jury trial last week.
Joel Teeley, the irrigation district’s general manager, said he was disappointed, but the district doesn’t plan to appeal.
The lawsuit, filed by the irrigation district last fall, centered on about 18 acres off Highway 397 in the Finley area.
The district agreed in 2007 to buy it for $36,000, with county commissioners authorizing the sale. But the sale never went through, and in 2008 the county sold the property to someone else for $15,000.
Teeley has said the land was “sold out from under us before we could complete the paperwork,” while the county said the district never submitted payment and a previous irrigation district manager eventually indicated his agency didn’t want the land anymore.
The judge also determined the county wouldn’t have been in breach of contract anyway because so much time had passed.
