A Kennewick man allegedly was caught in the act raping a young teen boy inside a car parked near a Pasco motel.
Jose David Lopez-Delatorre claims it was consensual sex, but the teen said he told the older man to stop.
Lopez-Delatorre, 32, is charged in Franklin County Superior Court with one count each of third-degree rape and third-degree rape of a child. The charges include the fact that the boy was under the age of 16 at the time of the alleged rape.
Lopez-Delatorre is scheduled to appear in court Tuesday to enter a plea.
Pasco police Officer Richard Leininger was dispatched at 3:48 a.m. Aug. 17 to check out a suspicious vehicle on the west side of the Sage 'N Sun Motel on 10th Avenue near the cable bridge, according to court documents.
He detained Lopez-Delatorre and, after being read his Miranda rights, the suspect agreed to tell the officer what was going on.
Lopez-Delatorre initially said he was just giving the teen a ride to his house. However, the teen told another officer at the scene that he was being raped when Leininger arrived, documents said.
Once at the jail, Lopez-Delatorre allegedly changed his story, claiming the sex was consensual, because he realized Leininger knew.
Lopez-Delatorre remains in the Franklin County jail on $100,000 bail, along with an Immigration and Customs Enforcement hold.
He has been ordered to have no contact with the boy while the case is pending.
