A grand jury has refused to indict an East Oregon man in a killing that investigators concluded was likely self-defense during a robbery attempt.
Investigators said Daniel Leonard Dechand, 25, of Hermiston, died Feb. 4 of gunshot wounds, and Timothy Allen Kelly, 22, of Irrigon, called a narcotics officer six days later to surrender.
The Umatilla County district attorney, Daniel Primus, said the grand jury heard the case Tuesday.
Primus says in a statement that Kelly told investigators he fired after Dechand reached under a seat as if to grab the weapon he claimed to have.
The prosecutor says there was an eyewitness, and substantial evidence supported the self-defense account.
The statement didn’t specify what sort of property was involved in the robbery attempt.
