More potential jurors were dismissed from the Tashia Stuart murder case Monday in Pasco.
Now, 67 jurors remain when general jury questioning begins at 9 a.m. todayat the Franklin County Courthouse.
Attorneys are attempting to pick 12 jurors and three alternates and then start opening statements and testimony later this week.
Stuart, 40, faces first-degree murder with aggravated circumstances and attempted first-degree murder charges related to the March 2011 shooting death of her mother, Judy Hebert, 58.
Never miss a local story.
The attempted murder charge stems from an incident two weeks before the fatal shooting when a heavy container of books was dropped on Herbert in her garage.
Her estranged husband, Todd Stuart, was acquitted in late September of plotting with his wife to kill Hebert so the couple could inherit the Pasco woman’s property.
Stuart had been living with her husband and daughter in her mother’s home on Salmon Drive in west Pasco. She claims that she acted in self defense after her mother came after her with an ax.
Court documents show that the two were arguing about the withdrawal of $300 from Hebert’s bank account before she was shot. They also detail “bizarre” questions Stuart asked her father in the weeks leading up to the shooting, including “what she would do if her mother started chasing her.”
In addition, Stuart repeatedly sought access to the combination for her mother’s safe, saying she needed to get Hebert’s last will and testament and do-not-resuscitate paperwork, Rolfe Hebert, the victim’s ex-husband and Stuart’s father, had said.
On May 28, 132 people responded to a jury summons to take part in jury selection. Jurors have been dismissed for various reasons, such as work conflicts, nonrefundable vacation plans, scheduled medical appointments and child care issues.
