SPOKANE -- A Moses Lake man who distributed pornographic images involving a baby is going to federal prison for five years.
Benjamin James Brekke, 23, admitted to sharing the graphic images, which showed the infant in a car seat being forced to perform oral sex on an adult man.
He was caught in October when he gave approximately 11 pictures to an undercover employee working with the Federal Bureau of Investigation, according to court records.
After Brekke was arrested, federal investigators got search warrants for his three cellphones. They found more than 1,500 images of child porn on one phone.
Brekke pleaded guilty in February to distribution of child pornography.
He was sentenced Wednesday by Judge Thomas O. Rice in Spokane's U.S. District Court.
The judge ordered Brekke to be a registered sex offender and be on supervised release for the rest of his life.
Brekke must participate in and complete a state-certified sex offender treatment program, and follow lifestyle restrictions such as not visiting adult bookstores and strip clubs and not calling sex-related adult numbers.
He also can't have contact with anyone under age 18 without the presence of an approved adult, can't be employed in a job where he'd have access to kids, and must stay 1,000 feet away from places where children congregate, including schools, playgrounds and arcades.
A charge of possessing child pornography was dismissed at sentencing as part of the plea agreement.
U.S. Attorney Michael C. Ormsby said the case fell under Project Safe Childhood, a national initiative launched in 2006 to combat the growing epidemic of child sexual exploitation and abuse.
"Prosecuting offenders who are not only collecting child pornography, but also distributing child pornography images is a priority of the United States Attorney's Office in the Eastern District of Washington," Ormsby said in a news release.
