Othello man charged with indecent exposure at Macy's

An Othello man is accused of exposing himself to a Macy's employee in the Kennewick store's shoe department.

Donald W. Gadberry, 55, pleaded innocent to one count of indecent exposure.

His trial is scheduled Sept. 29. Gadberry, who is out of custody on his personal recognizance, waived his right to a speedy trial to get the later date.

The employee, a 25-year-old woman, reportedly noticed that Gadberry was staring at her, instead of looking at shoes, during the Jan. 8 incident at the Columbia Center mall.

She approached him to see if he needed assistance, and that's when the employee noticed that Gadberry's penis was outside his shorts, court documents said.

The woman immediately left the area to tell two co-workers, who called mall security.

Gadberry was contacted by the security director outside the store and asked if he exposed himself on accident or on purpose, documents said.

He allegedly replied that it was by accident.

A store manager confirmed that the guy approached by mall security was the same man who'd been in the shoe department.

Gadberry has a 2010 indecent exposure conviction in Grant County District Court.

The new charge is for intentionally making an open and obscene exposure to the employee, knowing it was likely to cause reasonable affront or alarm, especially given his prior conviction.
