Two young men accused of shooting up a Pasco apartment, where three children and the intended target of the overnight drive-by were sleeping, pleaded innocent Tuesday in two separate gang clashes.
Miguel A. Paniagua, 19, is charged with kicking a 13-year-old boy in the head during a May 1 fight at the Pasco Flea Market.
Then early last Friday, Daniel Garcia, 18, and Richard Ray Castillo, 17, allegedly retaliated by opening fire on Paniagua's West Pearl Street apartment. No one was hurt in that incident.
Garcia and Castillo, both charged in Franklin County Superior Court with drive-by shooting, now face June 22 trials. The Pasco men are each being held on $50,000 bail.
Paniagua has a July 13 trial date for second-degree assault. His bail is $100,000.
Court documents state that during a gang fight at the East Lewis Place flea market, Paniagua beat Victor Villarruel in the face, sending the teen to the ground, then kicked him in the head until he was unconscious.
The teen turned 14 on May 5.
A 17-year-old boy also suffered a gunshot wound to his chest in the fight.
Witnesses told Pasco police that Paniagua had a pistol and held it within a foot of another person's face and told the man to "keep talking crap," documents said.
But no one is charged with the shooting.
In the second incident, officers were called at 12:49 a.m. May 10 after reports of men pointing a gun at a woman as she looked out her second-floor apartment window on West Pearl Street.
The witness said she saw two boys outside, and one with a gun attempted to conceal it when she talked to them, court documents said.
She gave police a description of their car.
At 1:35 a.m., police went back to the apartment complex after reports of shots being fired.
A Pasco officer saw a car matching the earlier description speeding near 22nd Avenue and Court Street.
He stopped the 1992 Lincoln Town Car with Castillo in the driver's seat and Garcia sitting behind him, documents said.
Jose Adan Larios, 15, also was a passenger and was arrested on suspicion of first-degree assault.
A shotgun was found by the front passenger seat, documents said.
Three 20-gauge shotgun shells were discovered in an alley north of the Pearl Street apartment, and the upstairs apartment was "peppered with a large amount of shotgun pellets," court documents showed.
Two children, 12 and 13, were asleep on a futon inside the apartment just under the window, while a 5-year-old boy slept nearby on a couch, documents said.
Paniagua is said to be a documented gang member, and Castillo is an associate of a rival gang, authorities said.
Castillo and Paniagua have been ordered to have no contact with witnesses or known gang members in person or by mail, phone, electronic means and through a third party.
Castillo also was told not to drive without a proper license and insurance, and must obey a curfew between 9 p.m. and 6 a.m. and live at his listed address while the case is pending.
Paniagua must follow a curfew that requires him to be home from 9 p.m. to 7 a.m.
