Ex-Prosser mayor changes attorneys for sex-crime trial

KENNEWICK -- Linda Lusk changed her defense team Tuesday in a move that will delay her sex crime trial at least two months.

The former Prosser mayor asked Judge Carrie Runge to allow Jim Egan and Larry Stephenson to become her new lawyers.

They are replacing Scott Johnson, who had represented Lusk since she was first charged in June with allegedly exchanging sexually explicit text messages and having sexual contact with a teenage boy.

Johnson told the court Tuesday that he only learned he had been replaced about three hours before the hearing, but added that he didn't think it was an attempt by Lusk to play a game on the judicial system.

Lusk, 50, is charged in Benton County Superior Court with third-degree child molestation, third-degree rape of a child and communicating with a minor for immoral purposes.

Her trial had been set for March 7.

But Stephenson pointed out the thick case file he and Egan now have to review, and said they "can't give her adequate representation without a continuance."

Stephenson said they need a minimum of two months to get ready.

"She is entitled to an attorney of her choice. She made that choice," he said, noting they had met with Lusk on Monday.

Prosecutor Andy Miller pointed out he had opposed the last two trial continuances because the victim wants the case to be over.

Miller said he was very concerned about the potential impact of another delay, but also said he knows Lusk's right to counsel is important.

Runge said the attorneys should be prepared at a Friday afternoon hearing to set a new trial date.
